By visiting Hoot & Hue and purchasing from us, you agree to the following terms.
1. The Art (Product Disclaimer)
- Handmade Nature: Many of our items are handcrafted. Small imperfections or variations in texture and color are part of the process and make your piece unique.
- Colors: We do our best to photograph art accurately, but screen settings vary. Actual colors may look slightly different in person.
2. Your Order
- Right to Cancel: We reserve the right to cancel any order for reasons like stock issues or suspicion of fraud. If we cancel, you will be fully refunded.
- Pricing: Prices are in INR and subject to change without notice.
3. Intellectual Property (Copyright)
- Hoot & Hue Content: The Hoot & Hue name, logo, branding, website design, and all content created by Hoot & Hue (including original photography, written copy, and curated layouts) are owned by Hoot & Hue.
- Guest Artist Artwork: Artwork, designs, and related creative content submitted by independent Guest Artists remain the property of the respective Guest Artist. Hoot & Hue does not claim ownership of Guest Artist artwork or content unless separately agreed in writing.
- Licence to Hoot & Hue: By listing artwork on Hoot & Hue, a Guest Artist grants Hoot & Hue a non-exclusive licence to display, reproduce, and use their artwork images, name, biography, and related material for the purpose of operating, advertising, and promoting the marketplace and the artist’s work.
- No Reproduction Rights for Buyers: Purchasing a physical artwork gives you ownership of that physical item only. It does not transfer copyright or reproduction rights, whether the work is created by Hoot & Hue or a Guest Artist. You may not scan, reproduce, or resell the underlying artwork without the rights holder’s written permission.
4. Guest Artist Products & Marketplace Terms
- Identification: Products listed by independent artists through our marketplace (“Guest Artist Products”) are identified as such on the relevant product page.
- Independent Relationship: Guest Artists are independent participants who list and sell work through Hoot & Hue. They are not employees, agents, partners, or representatives of Hoot & Hue, and Hoot & Hue is not responsible for their conduct except as set out in these Terms.
- Authenticity & Originality: Guest Artists represent and warrant that submitted work is their own original creation (or that they otherwise hold the necessary rights to sell it), and that the listing does not infringe any third party’s copyright or other rights. Hoot & Hue does not independently verify or guarantee the authenticity of every artwork, but may investigate any listing where authenticity or ownership is disputed.
- Accurate Listings: Guest Artists are responsible for ensuring product descriptions, materials, dimensions, and images accurately represent the item offered for sale.
- Availability & One-of-a-Kind Works: Many Guest Artist pieces are one-of-a-kind or available in limited quantity. Once sold or withdrawn by the artist, an identical piece may not be available again.
- Listing Review: Hoot & Hue reserves the right to review, suspend, or remove any Guest Artist listing at its discretion, including for accuracy, quality, or policy concerns.
- Fulfilment: Orders for Guest Artist Products may be fulfilled by Hoot & Hue or directly by the Guest Artist, depending on the arrangement for that listing.
- Customer Contact Point: Regardless of who fulfils the order, customers should direct all questions regarding orders, shipping, returns, and refunds to Hoot & Hue at info@hootandhue.com — not directly to the Guest Artist.
- Shipping & Refund Policies Apply: Our existing [Shipping Policy] and [Refund Policy] apply equally to Guest Artist Products.
- Damaged or Incorrect Items: If a Guest Artist Product arrives damaged or incorrect, contact Hoot & Hue directly so we can coordinate a resolution with the Guest Artist in line with our Refund Policy.
- Customer Data: Where customer information is shared with a Guest Artist to fulfil an order (e.g. for direct shipping), the artist may use that data solely for fulfilling the relevant order and for no other purpose.
- Suspension/Removal of Artists: Hoot & Hue may suspend or remove a Guest Artist or their listings for violations of these Terms, intellectual property infringement, suspected fraud, or repeated fulfilment problems.
- Disputes: Copyright, authenticity, or ownership disputes relating to a Guest Artist Product will be reviewed by Hoot & Hue, which may remove or suspend the listing pending resolution.
- Separate Artist Agreement: Guest Artists participate in the marketplace under a separate Guest Artist Agreement / Guest Artist Terms of Sale, which governs commission, payouts, fulfilment responsibilities, and the commercial relationship between the Guest Artist and Hoot & Hue.
5. Shipping & Returns
- Please review our separate [Shipping Policy] and [Refund Policy] pages. These policies are part of these Terms.
6. Liability
- We are not liable for any damages arising from the use of our products beyond the purchase price of the item.
7. Governing Law
- These terms are governed by the laws of India. Any legal disputes will be handled exclusively in the courts of Mohali, Punjab.
